1. Eligibility

• You must be at least 13 years of age to create an account on the Platform.
• If you are under 18 years of age ("Minor"), you may use the Platform only with verifiable consent from a parent or legal guardian, in accordance with the Digital Personal Data Protection Act, 2023 ("DPDP Act"). Our platform includes a guardian consent flow that requires OTP verification via an email sent to the guardian's address before a Minor's account is activated.
• By providing guardian consent, the parent or legal guardian agrees to these Terms on behalf of the Minor and accepts responsibility for the Minor's use of the Platform.
• We reserve the right to terminate accounts where verifiable guardian consent cannot be established for users identified as Minors.

2. Account & Username Rules

• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• Usernames must be unique and must not contain offensive, misleading, or impersonating content.
• Usernames are permanent once set and cannot be changed.
• We reserve the right to reclaim or reassign usernames that violate these rules or are inactive for an extended period.
• One account per person. Creating multiple accounts to circumvent restrictions is prohibited.

4. Acceptable Use & Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to reverse-engineer, decompile, or extract source code from the Platform.
• Scrape, crawl, or use automated means to access the Platform or its data without our express written permission.
• Upload or transmit viruses, malicious code, or any content that could harm the Platform or other users.
• Interfere with or disrupt the Platform's infrastructure, servers, or networks.
• Share your account credentials with others or allow others to access your account.
• Cheat, manipulate test results, or engage in any form of academic dishonesty on the Platform.
• Upload, post, or transmit content that is unlawful, defamatory, obscene, hateful, or that infringes on the rights of others.

5. User Content, Intellectual Property & Takedown

• Any content you submit through the Platform (e.g. test responses, profile information) remains yours. By submitting content, you grant us a non-exclusive, worldwide, royalty-free licence to use, process, and display it solely for the purpose of providing and improving the Platform.
• All Platform content, including but not limited to questions, analytics, branding, design, and software, is the intellectual property of {{LEGAL_ENTITY_NAME}} or its licensors and is protected by applicable intellectual property laws.
• You may not reproduce, distribute, or create derivative works from Platform content without our prior written consent.
• Takedown requests: If you believe any content on the Platform infringes your intellectual property rights, please contact us at support@apnarank.com with details of the allegedly infringing material, your ownership claim, and your contact information. We will review and act on valid requests promptly.

6. Pricing & Payments

• The Platform is currently free to use. There are no active paid plans or in-app purchases at this time.
• We may introduce paid features, subscription tiers, or premium content in the future. If we do, we will notify you in advance and clearly disclose pricing before any payment is required.
• Continued use of free features will not require payment.

7. Disclaimers, Limitation of Liability & Indemnification

• The Platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
• We do not guarantee that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.
• We do not guarantee that using the Platform will result in any specific exam outcome, rank, or score improvement (see Section 3 above).
• To the maximum extent permitted by applicable law, {{LEGAL_ENTITY_NAME}} shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the Platform.
• Our total aggregate liability for any claim arising from these Terms shall not exceed the amount you have paid us in the 12 months preceding the claim, or INR 1,000, whichever is greater.
• Indemnification: You agree to indemnify and hold harmless {{LEGAL_ENTITY_NAME}}, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising out of your violation of these Terms, your use of the Platform, or your infringement of any third-party rights.

8. Suspension & Termination

• By us: We may suspend or terminate your account at our discretion if you violate these Terms, engage in abusive behaviour, compromise Platform integrity, or if required by law. We will make reasonable efforts to notify you, except where prohibited by law or where immediate action is necessary.
• By you: You may request deletion of your account at any time by contacting us at support@apnarank.com. Deletion is a manual process; we will acknowledge your request within 48 hours and process it within 30 days. Once processed, changes may take up to 15 minutes to fully propagate across our systems.
• Effect: Upon termination, your right to use the Platform ceases immediately. We may retain certain data as required by law or for legitimate business purposes (see our Privacy Policy). Provisions that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) shall survive.

9. Third-Party Links

The Platform may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services. You access them at your own risk.

10. Governing Law, Jurisdiction & Dispute Resolution

• These Terms shall be governed by and construed in accordance with the laws of India.
• Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in {{JURISDICTION_CITY}}, India.
• Before initiating formal legal proceedings, both parties agree to attempt to resolve disputes amicably through good-faith negotiation for a period of at least 30 days.

11. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, power failures, internet outages, or acts of war or terrorism.

12. Severability, Entire Agreement & Assignment

• Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
• Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the Platform and supersede all prior agreements.
• Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. For material changes, we will make reasonable efforts to notify you (e.g. via a banner on the Platform or an email notification). Continued use of the Platform after changes constitutes acceptance of the updated Terms. We encourage you to review this page periodically.
